Property Dispute Arbitration Process
We have a fast structured and transparent Arbitration process in Dublin that is tailored to your needs. Each step is designed to keep things clear, avoid delays and deliver a fair resolution. The Arbitration process involves the following:
A property Arbitrator with experience in valuation, boundary and lease disputes will be appointed. The appointed property Arbitrator will approach the arbitration in an impartial and professional manner.
Hearings will be considered and organised to deal with the precise dispute, whether it is a rent review, valuing a property or access dispute. Hearings will take place either in person in Dublin at one of our three venues.
Both parties will submit their own valuations, expert reports and witness statements or reports including documentation. As necessary, and in some cases important, the Arbitrator may undertake site visits across Dublin to understand the full context of the dispute.
After considering the evidence submitted the Arbitrator will make a binding Award which is enforceable in the same way as if it was a judgment of the High Court.
The nature of arbitration means that there is a limited scope for the intervention of the courts in respect of arbitration so there will be a fast, efficient and definitive resolution to the property dispute in Dublin.
After the Award is issued, both parties are required to comply with its terms within the set timeframe. This ensures the decision is effectively implemented and the property dispute reaches a clear and lasting resolution.
